Power of attorney (carta poder) examples?

I just bought a bike from another rider and will be riding it around in January/February. I need to have him write up a Carta Poder/Power of Attorney for me that grants me all of the powers of an owner of the bike, including the right to sell, transfer, etc. Does anyone have an example of a power of attorney that has worked for them in South America that I could look at? I've been searching for a long time and haven't found anything, but did see some posts about people having good and bad experiences with their power of attorney, seemingly based on how it was written. I want to make sure mine is written such that I don't have those problems.

Can't vouch for its success rate yet but this is part of the wording of mine

.....para que conduzca el referido vehiculo por todo el territorio nacional y lo exporte a los paises limitrofes y la republica oriental del Uruguay en admision temporaria turistica. a tal efecto lo faculta para conducir el vehiculo y transitar libremente en el por todo el territorio de la republica argentina y por los paises limitrofes cumpliendo las disposiciones de transito y aduaneras vigentes y las demas formalidades que en cada correspondan .....

Hi SB... The way power of attorneys are acceptable can be country specific. I want to help, but need to know the facts. Please answer the following questions.

1. In what country is the bike registered?

2. Is the registered owner of the bike a legal permanent resident of the country the bike is registered in or not? If not what nationality is the owner and where is his/her legal residence?

3. Where will the insurance be purchased? You will need to carry proof
of insurance along with a power of attorney.

4. Was the bike entered into the country where you will begin your ride entered on a Temporary Vehicle Import Permit?

Keep in mind that there may be problems exiting a bike registered in one MERCOSUR country to another Mercosur if the owner entered that country on a tourist visa and then purchased the bike. Sometimes, the paperwork is checked and verified at the exit of the country you are leaving and at the entrance of the country you are entering.

Remember to check with the company that is insuring the bike and get
in writing that the bike will still be covered by insurance while you use the bike, and that if the bike is not in the country of issurance of the insurance, that the bike will be "legal" in whatever country you intend to visit. This is important because insurance companies readily use the excuse that the rider or the bike was not "legal" in some way, even very obscure ways, so that the insurance company does not have to pay liability claims. It is not a good idea to give the insurance company any wiggle room as it is possible if you are involved an accident with personal injury or property damage, and your insurance backs out, that you will be arrested and remain in jail until a judge can sort out the accident and assign fault and payable damages. This process could take months or more.

Para conducir en cualquier Estado Parte del MERCOSUR, el conductor necesita solo el documento de conducción vigente, emitido por su país, aunque no sea nacional de uno de los Estados Partes.
Para alquilar un automóvil, la mayor parte da las locadoras exige que el extranjero posea una tarjeta de crédito internacional válida.

Los conductores, en cualquier Estado Parte del MERCOSUR, deben seguir las normas y reglamentos del Código Nacional de Tránsito del país que estén visitando. El pago de los peajes debe ser efectuado en la moneda nacional. En algunos Estados Partes como Uruguay se aceptan dólares, pesos argentinos y reales.


Circulación de Vehículos Particulares en otro Estado Parte

Si el conductor reside en uno de los Estados Partes del MERCOSUR y utiliza un vehículo registrado o matriculado en este país:

Para transitar en un Estado Parte diferente del Estado Parte de registro o matrícula del vehículo (automóviles, motocicletas, remolques), el conductor deberá contar con la siguiente documentación:

• Documento de identidad válido para transitar en el MERCOSUR;

• Licencia para conducir;

• Documento que lo califica como turista, emitido por la autoridad migratoria;

• Título u otro documento oficial que compruebe la propiedad del vehículo;

• Comprobante de seguro vigente (tarjeta verde Res. Nº 120/94) (certificado de la póliza de seguro de responsabilidad civil por daños causados a personas y objetos no transportados en el vehículo, a favor del propietario o conductor del vehículo, con cobertura en los Estados Parte por los que transite).

El transito de esos vehículos no estará sujeto al cumplimiento de formalidades aduaneras, sin perjuicio de los controles que la autoridad aduanera ejerce para la verificación del cumplimiento de las condiciones y requisitos exigibles.

El plazo de permanencia del vehículo en el territorio de un Estado Parte diferente de lo de registro o matrícula será concedido por la autoridad migratoria al titular del vehículo o a la persona por él autorizada a conducirlo.
El conductor deberá ser residente en el Estado Parte de registro o matrícula del vehículo. La residencia será comprobada mediante documento de identidad válido en el ámbito del MERCOSUR. En caso de extranjero que no lo posea, la misma será comprobada mediante certificado de residencia expedido por el órgano competente del Estado Parte donde reside.

El vehículo registrado en un Estado Parte del MERCOSUR, debe ser conducido en otro Estado Parte únicamente por el propietario o por una persona por él autorizada. En el territorio de cada Estado Parte, esos vehículos pueden ser conducidos por el cónyuge o por familiares del propietario, hasta el segundo grado de consaguinidad, sin necesitar autorización expresa, desde que puedan comprobar la vinculación con la documentación correspondiente.

Si estas personas (incluso el propietario del vehículo) se retiraren del país, la permanencia del vehículo en el Estado Parte será admitida mediante previa comunicación formalizada en la Aduana de Jurisdicción del local donde esté el vehículo. Será concedido un plazo máximo de 90 días (por una única vez e improrrogable) para la permanencia del vehículo, sin derecho a uso, contados a partir de la comunicación por parte del interesado.
En caso de accidente, hurto, robo u otra situación de fuerza mayor, que impidan el retorno del vehículo al Estado Parte de origen, el responsable deberá comunicar el hecho a la autoridad aduanera que jurisdiciona el local donde ocurrió el mismo.

Para eso, deberá presentar la documentación comprobatoria correspondiente, para que la autoridad aduanera adopte, de forma inmediata y sin cualquier formalidad previa, las medidas pertinentes.



Transito de Vehículos Alquilados por ciudadanos del MERCOSUR en otro Estado Parte

Para transitar en otro Estado Parte con un vehículo alquilado, el ciudadano del MERCOSUR necesita la siguiente documentación:

• Documento de identidad válido para transitar en el MERCOSUR;

• Licencia para conducir;

• Documento que lo califica como turista, emitido por la autoridad migratoria;

• Autorización para Circulación en el MERCOSUR (ACM): documento emitido por la Empresa Locadora de Vehículos que incluye la indicación de los principales datos del contracto de alquiler del vehículo, además de los referentes a su identificación y seguro. La vigencia de la ACM no podrá, en ningún caso, superar los 90 días contados a partir de su emisión.

El plazo de permanencia de un vehículo de alquiler en el territorio de un Estado Parte diferente al registro o matrícula será concedido por la Autoridad Migratoria al locatario o será el plazo de vigencia de la Autorización para Tránsito en el MERCOSUR, el que el término ocurra primero.

Si el retorno del vehículo al Estado Parte de origen no puede ser efectuado por el locatario, su reingreso podrá ser realizado por su empleado o por una persona contratada exclusivamente para este fin, mediante autorización expresa de la empresa locadora. En este caso el requisito de residencia del conductor en el Estado Parte de registro o matrícula del vehículo no será exigido. El locatario o locador deberán exponer esta situación, para el conocimiento de la Aduana de jurisdicción del local donde esté el vehículo.

En caso de tener un accidente de tránsito en el territorio de cualquiera de los Estados Partes del MERCOSUR, se aprobó el Protocolo de San Luis que regula el derecho aplicable y la jurisdicción internacionalmente competente, en casos de responsabilidad civil emergente de accidentes de tránsito ocurridos en territorio de un Estado Parte, en los que participen o resulten afectadas personas domiciliadas en otro Estado Parte. El mismo fue internalizado al ordenamiento jurídico de cada Estado Parte, mediante las siguientes disposiciones:

Argentina: Ley Nº 25.407 del 07/03/01
Brasil: Decreto Nº 3.856 del 03/07/01
Paraguay: Ley Nº 1205 del 23/12/97
Uruguay: Ley Nº 17.050 del 14/12/98


Asimismo, a la hora de conducir por el territorio de cualquiera de los Estados Partes, se deberá tener en cuenta las siguientes normativas relativas a las condiciones de los vehículos:

Thanks Tony, that looks helpful. Would it be possible to PM me the rest of it as well? (removing anything identifying or sensitive, of course). Or is there nothing else important in it?

xfiltrate - bike's registered in the US, he entered Uruguay on a tvip there. You've posted on another of my threads about the tvip, just looking for info on the wording of the carta here. I'll read through the mercosur stuff as well.

Boludometro

As the inventor of the Boludometro - a hand held device that measures the quantity of Boludo in a person, place or event, relying on data provided by satellites orbiting the earth - on a scale of 1 - 5, a device that I exhibited at one of the HUBB meets in *Viedma, Argentina, I can assure you that the MERCOSUR regulations I have provided are less restrictive rgarding the trans national transport of US registered bikes between Mercosur countries than they potentially could be for the transport of locally (MERCOSUR) purchased bikes.

*And, I have regretted ever since.....

The boludometro can also measure the beauty of a woman same 1 - 5 scale ..... haveing very little to do with physical attributes _a feature that has assisted my social life 10X.

You may be able to exit and enter MERCOSUR countries if the original owner assists with exit. This means you ride pillion - he/she exits the bike
and you , using your power of attorney - with appropriate legal insurance enter with a TVIP the next MERCOSUR country. There are strict regulations regarding the sale of "foreign" bikes in MERCOSUR countries , but a POA does seem to work if worded correctly and notarized by appropriate authority.

On a scale of 1 - 5 my boludometro indicates that your venture will be relatively free of problems, if you adhere to all legalities.
