Does anyone living in the States know what would happen if you were riding an older or Eruopean-spec bike off-road with no spark arrestor? Is this something the police would actually look for?

Yes they are required and both state and federal forest service rangers do check for the approval stamp but they also will probe it to see if the screen is in place.
I have read that a factory exhaust is OK but I am not sure if that is true or if the rangers know that. They can give you a ticket then you can fight it in court.

mmmm, a factory exhaust from the mid 60s might fall short on that!
I guess being a foreigner if I do get ticketed I can just bugger off.....

It's not a BSA, but if all goes according to plan it will be a 2012 bike with a '68ish engine. I'm currently trying to track down a 650 Triumph twin to power it.

I'm not clear whether henryuk is asking about riding such a bike on road or off, and I'm not clear if his intended bike is missing the actual arrestor or just the sticker.
If riding off road, it might be a good thing to bear in mind that there are valid reasons for requiring spark arrestors. We have enough of our own yahoos starting forest fires by various means without importing more from afar.
IMHO, of course.

add ons
From any motorcycle racing store you can get, or order online. an approved spark arrestor screen...if you have room on exhaust to screw it on it's like a little bowler hat, or shaped like the top of a condom...well more round like -
you only are required on Federal and State lands to have a spark arrestor in most states...but some require it anywhere off-road...just get one and 3 self drilling screws, and a cordless drill - you are done.
I've seen them for $25 dollars online...I think Moose Racing sells them ??
