Bit Off Topic, Bike Clamped And Taken Uk
Sorry all for going off topic slightly..bike clamped and taken yesterday by cowboy clampers in w. london.....was not even parked in a space....asking for 330 pounds which I honestly do not have at the mo and the bike is not worth that anyway..it is an old kawa 550 gt with a blowing head gaslet...I have called to try and get stuff from topbox and get the tax disc off for a refund but no luck with these evil people....tiny signs at the supermarket and bike was there for 4 minutes only.
come at a bad time as I was going to use it to go to a new job....any input from anyone as to suggestions..?
oh yes and when I said cannot afford to come and get bike..tried to scare me and told that they will pass details on to bailiffs and it will cost me hundreds in the long run..lovely people.....great to come back to the uk to work for a few weeks to save some much needed money..!

mate sorry to say but they got you by the b"""s ,same thing happen to a mate left bike outside gym on private property got bike taken away they were asking nearly £500 he works in lambeth parking services his wife is a bloody solictor he couldnt do anything about it maybe he deserved it , but he still paid up maybe he will think twice now when dealing with people parking tickets ,if you dont want the bike back or dont want to pay then send off log book saying you sold bike a few weeks ago to joe bloggs ,have dun this many times to avoid tickets with old cars best of luck dealing with these rat bags

If you were parked in a supermarket, don't keep it to yourself.... which one was it so we can boycott it? If it's one I use I'll complain at my local one as well.
Also, there are rules now about the size of the signs etc. So see your local trading standards office at the townhall to make sure all the signs are legal and the clampers are licensed. They might not be and you may not be the only one complaining. I think there are rules about how much they can charge as well, but don't really know.
The stuff in your topbox is your property so should be returned to you. Try trading standards or Citizens Advice for advice on that one.
Also look at Parking tickets, appeal parking ticket, parking ticket challenge, beat parking tickets, unfair parking ticket,illegally parking tickets,challenge invalid parking tickets,appeal unfair parking tickets. They have useful advice but you have to join to get to most of it.
Put the name of the clampers into google see what you get.

for those up north
If you get a ticket in morrisons or any of the other big national chains up in scotland, check where the solicitors that send the letter[or collection agency threatening court action] is as they have no powers in scotland and the type of courts they threaten you with dont exist up here. Know lots of people who have had them and promptly told the company seeking the money to go away.

Well clamped sat I have got it back monday.....found out who owns the land and went to their office....also have got a story about it going in the local paper and my M.P.s office have called me for a full account..soon as the local paper phoned the landowners I got a call 15 mins after to go and get bike. They hate publicity..Still had to pay 100 pounds towaway though....better than 330 they were after...
If you are clamped check the clamper has a valid FRONTLINE SECURITY INDUSTRY AUTHORITY badge, if not call police as they need this to clamp. On the clamping ticket the SIA number will appear,it is a 20 digit number followed by name....first ask who do I have to pay..they will say me.ask did you clamp it..they will say yes as they want the money...then ask where is your SIA badge..IT MUST BE ON DISPLAY FOR FRONTLINE CLAMPERS...if they do not have it say you are calling the police as they cannot clamp. Person that puts the clamp ON must have the frontline SIA badge that appears on the ticket. Some only have one employee with a badge and various guys use the number. Also say you are going to call the SIA in merseyside to report false use of the permit. The guy that comes back and removes clamp does not need a pass so try and get the guy you come across to say that he put the clamp on. Always pay by card if you can as you can call card company straight away and say payment was made by coercion and pressure.....Also you can check on SIA website to see if permit is valid, real and up to date....good luck.

It's completely illegal under our Constitution:
1688/9 Bill of Rights (which establishes Parliament, amongst other things, so they can't get rid of it), which restored recognition of our unalienable Human Rights as expressed via the Common Law, after the Glorious Revolution.

"That all Grants and Promises of Fines and Forfeitures of particular persons before Conviction are illegall and void."
Read it all, then read it again - you may be as gobsmacked as I was when I first read it.
There are at least two other areas that are significant with this regard, the first of which is Magna Carta:
"We will appoint as justices, constables, sheriffs, or other officials, only men that know the law of the realm and are minded to keep it well. "
and the most important, is failure to comply with those very concrete Constitutional requirements, puts our Monarch in breach of her Coronation Oath.
Which of course, is Treason as well as Malfeasance in Office.
Demand a refund.
eta: This is most important to grasp - PAY on the spot fines, THEN claim them back! If you don't pay and go to Court, then due process is carried out. If you make payment with no Court case, then they are in clear breach of the Constitution and MUST pay it back, with damages and costs, and should go to Court as defendants themselves (because acceptance of a payment for a fine prior to conviction, is concrete proof that promises and grants of fines and forfeitures, have actually been carried on - so they fall into a trap of their own making).

I am not sure if the situation is the same in UK as Ireland.
My sister who is a solicitor told me that when you park on private land and there is a parking notice posted you are automatically agreeing to their conditions and you enbter into a civil contract. They can then pursue you in the courts with increasing charges of course.
Some places just issue tickets although I am not sure how they get access to your details to pursue you. However, if they have clamped or towed you then these don't matter.
Personally I find it disagreeable that more and more groups can help themselves to your cash almost at will.
