I live and work in Peru, with motorcycle tourism, and will inform you that it is ILLEGAL to sell in ANY country in South America (except maybe in Punta Arenas in southern Chile as it is a tax-free zone) unless it is registered in that country. In order to do this you must go through the 3 week process to change from your TVIP promise under which you entered Peru (promising that you WOULD NOT leave the moto in Peru UNDER ANY CIRCUMSTANCES), paying all the taxes, etc. YOU must be present for this whole process. Once the moto is licensed (and it must be LESS that 5 years old (2014+) in Peru, then you can sell it to someone else as a Peruvian Registered motorcycle.

Once the TVIP expires two things will happen. (1) a CAPTURE order will go out for the motorcycle and whoever is riding it as it is now property of the Peruvian government (no way to pay your way out of that one), and (2) a charge of TAX FRAUD will be attached to your passport in case you ever come back to Peru.

People are saying that you can just give a Power of Attorney to the next person.... but they are cracking down now at the borders on those arrangements...

That said, unless you sell it to someone who is uninformed of these things, you will only get pennies for it as parts (and there are no engines even similar to this one in Peru).

Hate to burst your bubble, but we Americans can be quite arrogant concerning the laws in other countries....

Come on mate not again.

This is exactly what will happen with this bike:

She will sell it. The new owner will have a poder. If the new owner is concerned with having the plates in their name they'll contact Overland Title Services and get new US plates made in their name and swap them between borders. The new owner will ride it around south America, the same as countless others.

Got any info on the "crackdown" on using a poder?

Because I've got two bikes in Cusco at the moment on a combo of 3 poders... Just suspended my CIT (TIP) and I'm going home to get some more tokens.

The guy I bought the second bike from had a bike on poder number 4...

Let me guess though, if she rides it up to you you'll give her a "reasonable" price for it.

Toby is 100% correct in that it is illegal to sell it in Peru... But the border guards at 2 Peruvian crossings tried to buy my bike for cash "sin papeles"... So who exactly will come knocking if you've sold it? No one.

If you want to do it legitimately the import tax is only actually 9% and whilst at Desaguadero the other day the aduana told me it's pretty simple if I did want to do it.

Another helpful post Toby, good work.

Membership - help keep us going!

Horizons Unlimited is not a big multi-national company, just two people who love motorcycle travel and have grown what started as a hobby in 1997 into a full time job (usually 8-10 hours per day and 7 days a week) and a labour of love. To keep it going and a roof over our heads, we run events all over the world with the help of volunteers; we sell inspirational and informative DVDs; we have a few selected advertisers; and we make a small amount from memberships.

You don't have to be a Member to come to an HU meeting, access the website, or ask questions on the HUBB. What you get for your membership contribution is our sincere gratitude, good karma and knowing that you're helping to keep the motorcycle travel dream alive. Contributing Members and Gold Members do get additional features on the HUBB. Here's a list of all the Member benefits on the HUBB.
