Overstaying Carnet de Passage in India - what are the penalties?

Hi all,

I am currently in the unfortunate situation that my motorcycle is stuck in India and might be so beyond the validity of the CdP I entered with. I already have the follow-up CdP on hand but as I understand that does not mean that customs needs to honour that.

Does anyone have any experience regarding the penalties for a vehicle overstaying the CdP in India?

I would say knowing Indian bureaucracy the consequences will be serious, it has 180 days after entry before the trouble starts, it would help if you could give us more information about its circumstances but if you could get it out of the country to somewhere like Nepal including getting the carnet stamped out it would be a start.

My bike is in parts at the service garage. Moving it to Nepal is not an option. The bike still has over 3 months left on the 180 days - but only a month on the current CdP validity.

Exceeding the 180 day period is a serious matter liable to result in payment of import duty or seizure of the vehicle. Switching from one valid carnet to another within this 180 days is a minor paperwork matter in my experience.

Do you have any suggestion or idea whom I could turn to regarding the restamping? I have not been able to get hold of anyone at customs in Delhi. And like I said, the motorbike can currently not be moved. Thanks.

Horizons Unlimited is not a big multi-national company, just two people who love motorcycle travel and have grown what started as a hobby in 1997 into a full time job (usually 8-10 hours per day and 7 days a week) and a labour of love. To keep it going and a roof over our heads, we run events all over the world with the help of volunteers; we sell inspirational and informative DVDs; we have a few selected advertisers; and we make a small amount from memberships.
